Data protection

This data protection declaration clarifies the type, scope and purpose of the processing of personal data (hereinafter referred to as "data") within my website www.janinaschick.com (hereinafter referred to as "website") and the websites, functions and content associated with it, as well as external ones Online presence, such as our social media profile (hereinafter jointly referred to as "online offer"). With regard to the terms used, such as "processing" or "person responsible", we refer to the definitions in Article 4 of the General Data Protection Regulation (GDPR).

COLLECTION AND STORAGE OF PERSONAL DATA AND NATURE AND PURPOSE OF USE

Personal Data

Personal data is information that can be used to find out your identity. This includes your name, address, postal address and telephone number. Information that is not associated with your identity (such as the number of users of a website) is not included. In principle, you can use my online offer without disclosing your identity.

There are logs for the statistical evaluation of website access. These contain the accessed URLs and IP addresses. Data that may allow identification (IP address) is not stored permanently. I cannot draw any conclusions about the user himself, but only statistically record how often which page was accessed and where these views came from, eg via Google search.

When you request information, order e-books, or make other inquiries, we ask for your name and other personal information. You are free to decide whether you enter this data.

Insofar as the usage or traffic data is required for our services, it will be stored for a maximum of six months after the data has been collected. If the data is required to fulfill existing legal, statutory or contractual retention periods (e.g. invoices), this data will also be stored beyond that. However, this data is blocked and only a few authorized persons can access it using passwords.

When visiting the site

When you visit our website, the browser used on your device automatically sends information to the website server. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored until it is automatically deleted:

  • IP address of the requesting computer,

  • date and time of access,

  • name and URL of the retrieved file,

  • Website from which access is made (referrer URL),

  • Browser used and, if applicable, the operating system of your computer and the name of your access provider.

The data mentioned are processed for the following purposes:

  • Ensuring a smooth connection establishment of the website,

  • Ensuring comfortable use of our website,

  • Evaluation of system security and stability as well

  • for other administrative purposes.

The legal basis for data processing is Art.6 Para.1 S.1 lit.f GDPR. The legitimate interest follows from the data collection purposes listed above. Under no circumstances do I use the collected data for the purpose of drawing conclusions about you.

In addition, I use cookies and analysis services when visiting the website. You can find more detailed explanations on this below.

When signing up for my newsletter

If you have expressly consented in accordance with Art. 6 Para. 1 S. 1 lit. ) to send. To receive the newsletter, it is sufficient to provide an e-mail address and a first name for personal address. 

You can unsubscribe at any time, for example via a link at the end of each newsletter. Alternatively, you can also email your unsubscribe request to info@janinaschick.com at any time.

Newsletter – measurement of success

The newsletters contain a so-called "web beacon", ie a pixel-sized file that is retrieved from our server when the newsletter is opened or, if we use a shipping service provider, from their server. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval, are initially collected.

This information is used to technically improve the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined using the IP address) or the access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is neither our aim nor, if used, that of the shipping service provider to monitor individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

When using the contact form

If you have any questions, I offer you the opportunity to contact me using a form provided on the website. It is necessary to provide a name and a valid e-mail address so that I know who the request came from and to be able to answer it. Further information can be provided voluntarily.

The data processing for the purpose of contacting me takes place in accordance with Article 6 Paragraph 1 Sentence 1 lit. a GDPR on the basis of your voluntarily given consent. The personal data collected for the use of the contact form will be deleted after your request has been dealt with.

Transfers to third countries

If data is processed in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or this happens as part of the use of third-party services or disclosure or transmission of data to third parties, this only takes place if it is to fulfill my (pre)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of legitimate interests. Subject to legal or contractual permissions, I only process or have the data processed in a third country if the special requirements of Art. 44 et seq. GDPR are met. This means that the processing takes place, for example, on the basis of special guarantees, such as the officially recognized determination of a data protection level corresponding to that of the EU (e.g. for the USA through the "Privacy Shield") or compliance with officially recognized special contractual obligations (so-called "standard contractual clauses").

Cooperation with processors and third parties

If I disclose data to other people and companies (contract processors or third parties) as part of the processing, transmit them to them or otherwise grant them access to the data, this is only done on the basis of legal permission (e.g. if the data is transmitted to third parties, as to payment service providers, pursuant to Art. 6 (1) (b) GDPR is required for the fulfillment of the contract), you have consented, a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.). If we commission third parties to process data on the basis of a so-called "order processing contract", this is done on the basis of Art. 28 DSGVO.

hosting and email delivery

The hosting services I use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, e-mail dispatch, security services and technical maintenance services that I use to operate this online offer. In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data from customers, interested parties and visitors to this online offer on the basis of our legitimate interests in making this online offer available efficiently and securely in accordance with Art. 6 Para. 1 lit. f GDPR in conjunction with Art. 28 GDPR (conclusion of order processing contract).

TRACKING TOOLS

The tracking measures listed below and used by me are carried out on the basis of Art.6 Para.1 S.1 lit.f DSGVO. With the tracking measures used, I want to ensure that my website is designed to meet needs and is continuously optimized. On the other hand, I use the tracking measures to statistically record the use of my website and to evaluate it for the purpose of optimizing my offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

The respective data processing purposes and data categories can be found in the corresponding tracking tools.

Google Analytics

For the purpose of the needs-based design and continuous optimization of our pages, I use Google Analytics, a web analysis service provided by Google Inc.(https://www.google.de/intl/de/about/) (1600 Amphitheater Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). In this context, pseudonymised usage profiles are created and cookies are used. The information generated by the cookie about your use of this website such as

  • browser type/version,

  • operating system used,

  • referrer URL (the previously visited page),

  • host name of the accessing computer (IP address),

  • time of server request,

are transferred to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage for the purposes of market research and the needs-based design of these websites. This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized so that an assignment is not possible (IP masking).

You can prevent the installation of cookies by setting the browser software accordingly; however, I would like to point out that in this case you may not be able to use all the functions of this website to their full extent.

Facebook pixels

On this website we use the Facebook Pixel from Facebook, a social media network from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA.

The code implemented on this page can evaluate the behavior of visitors who came to this website from a Facebook advertisement. This can be used to improve Facebook ads and this data is collected and stored by Facebook. The data collected cannot be viewed by us and can only be used in the context of placing advertisements. Cookies are also set by using the Facebook pixel code.

By using the Facebook pixel, the visit to this website is communicated to Facebook so that visitors to Facebook can see suitable ads. If you have a Facebook account and are logged in, visiting this website will be associated with your Facebook user account.

Google Adwords Conversion Tracking

We also use Google Conversion Tracking to statistically record the use of our website and to evaluate it for you in order to optimize our website. Google Adwords places a cookie on your computer if you have reached our website via a Google ad. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer's website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page. Each Adwords customer receives a different cookie. This means that cookies cannot be tracked via the websites of Adwords customers. The information obtained using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers are informed of the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information with which users can be personally identified.

If you do not want to participate in the tracking process, you can also refuse the setting of a cookie required for this - for example via a browser setting that generally deactivates the automatic setting of cookies. SOCAL MEDIA PLUGINS

Facebook

Plugins from the social network Facebook, provider Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA, are integrated on my website. You can recognize the Facebook plugins by the Facebook logo. You can find an overview of the Facebook plugins here: https://developers.facebook.com/docs/plugins/?locale=de_DE.

When you visit my website, a direct connection is established between your browser and the Facebook server via the plugin. Facebook receives the information that you have visited my website with your IP address. I would like to point out that we, as the provider of the website, have no knowledge of the content of the data transmitted or how it is used by Facebook. Functions of the Instagram service are integrated on my website. These functions are offered by Instagram Inc., 1601 Willow Road, Menlo Park, CA 94025, USA.

If you are logged into your Instagram account, you can link the content of my website to your Instagram profile by clicking on the Instagram button. This allows Instagram to associate your visit to our site with your user account. We would like to point out that I, as the provider of the pages, have no knowledge of the content of the transmitted data or how it is used by Instagram.

The Instagram plugin is used on the basis of Art. 6 (1) lit. f GDPR. The website operator has a legitimate interest in the widest possible visibility in social media.

LinkedIn

Our website uses functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.

Each time one of our pages that contains LinkedIn functions is accessed, a connection to LinkedIn servers is established. LinkedIn is informed that you have visited our website with your IP address. If you click on LinkedIn's "Recommend" button and are logged into your LinkedIn account, LinkedIn is able to assign your visit to our website to you and your user account. I would like to point out that, as the provider of the pages, I have no knowledge of the content of the transmitted data or how it is used by LinkedIn.

Google reCAPTCHA

I use “Google reCAPTCHA” (hereafter “reCAPTCHA”) on my websites. The provider is Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google").

With reCAPTCHA it should be checked whether the data entry on my website (e.g. in a contact form) is done by a human or by an automated program. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For analysis, reCAPTCHA evaluates various information (e.g. IP address, length of stay of the website visitor on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

Data processing takes place on the basis of Art. 6 Para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and from SPAM.

You have the right:

  • to request information about your personal data processed by me in accordance with Article 15 GDPR. In particular, you can obtain information about the processing purposes, the category of personal data, the categories of recipients to whom your data was or will be disclosed, the planned storage period, the existence of a right to correction, deletion, restriction of processing or objection, the existence of a Right to complain, the origin of your data, if not collected from us, and the existence of automated decision-making including profiling and, if necessary, meaningful information about their details;

  • in accordance with Art. 16 GDPR, to immediately request the correction of incorrect or incomplete personal data stored by me;

  • According to Art. 17 GDPR, to request the deletion of your personal data stored by me, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims is required;

  • in accordance with Art. 18 GDPR to demand the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you reject its deletion and I no longer need the data, but you use them to assert, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 GDPR;

  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided to me in a structured, common and machine-readable format or to request transmission to another person responsible;

  • pursuant to Article 7, paragraph 3 of the GDPR, to revoke the consent you have given me at any time. As a result, I am no longer allowed to continue the data processing based on this consent for the future and

  • according to Art.77 GDPR to complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or work or our office.

Right to object

If your personal data is processed on the basis of legitimate interests in accordance with Art.6 Para.1 S.1 lit.f GDPR, you have the right to object to the processing of your personal data in accordance with Art.21 GDPR, provided there are reasons for this, which arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which we will implement without specifying a particular situation.

Data Erasure and Storage Duration
The personal data of the person concerned will be deleted as soon as the purpose of storage no longer applies. Storage can also take place if this has been provided for by European or national laws or other regulations to which the person responsible is subject. The data will also be blocked or deleted if a storage period prescribed by the regulations mentioned expires, unless there is a need for further storage of the data for the conclusion or fulfillment of a contract.

Integration of third-party services and content.

I use content or service offers from third-party providers within my online offer based on my legitimate interests (ie interest in the analysis, optimization and economic operation of my online offer within the meaning of Art. 6 Para. 1 lit. f. DSGVO) in order to improve their content and Integrate services such as videos or fonts (hereinafter uniformly referred to as "content"). This always presupposes that the third-party providers of this content perceive the IP address of the user, since without the IP address they could not send the content to their browser. The IP address is therefore required for the display of this content. I try to only use content whose respective providers only use the IP address to deliver the content.
